GYM MEMBERSHIP LIABILITY WAIVER & RELEASE

ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

This Agreement is entered into between the undersigned participant (“Participant”) and Renshaw Innovations, LLC, doing business as Iron Gym (“Company”), located in Park Hills, Missouri.

1. Acknowledgment of Risk

Participant understands and acknowledges that participation in gym activities, strength training, cardiovascular exercise, weightlifting, functional training, and use of fitness equipment involves inherent risks, including but not limited to:

• Muscle strains, tears, and sprains
• Joint injuries
• Cardiovascular events
• Slips, trips, and falls
• Equipment malfunction
• Improper use of equipment
• Overexertion
• Contact with other participants
• Serious bodily injury
• Permanent disability
• Death

Participant understands that these risks exist whether or not caused by the negligence of the Company, its owners, employees, agents, contractors, or other participants.

2. Voluntary Participation

Participant voluntarily elects to participate in activities at Iron Gym and to use the gym facilities, equipment, and services with full knowledge of the risks involved.

3. Release of Liability

Participant hereby releases, waives, discharges, and covenants not to sue Renshaw Innovations, LLC, Iron Gym, its owners, officers, directors, employees, contractors, agents, volunteers, successors, and assigns from any and all claims, demands, damages, actions, causes of action, or liabilities of any kind arising out of or related to:

• Participation in gym activities
• Use of equipment
• Presence on the premises
• Any injury, illness, disability, death, or loss

Including claims arising from the negligence of the Company or its representatives, to the fullest extent permitted under Missouri law.

4. Indemnification

Participant agrees to indemnify and hold harmless Renshaw Innovations, LLC and Iron Gym from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to Participant’s actions, omissions, participation, or use of the facilities.

5. Medical Representation Participant represents that:

• They are physically and medically able to participate in exercise activities
• They have no condition that would make participation unsafe
• They assume full responsibility for their physical condition
• They will seek medical advice before participating if needed

Iron Gym does not provide medical screening, diagnosis, or medical supervision.

6. No Supervision Disclaimer

Participant understands that:

• Iron Gym may not provide supervision, training, instruction, or monitoring
• Use of equipment may be unsupervised
• Participant is solely responsible for safe and proper use of all equipment

7. Compliance with Rules

Participant agrees to follow all posted rules, policies, and staff instructions, and acknowledges that failure to do so may result in termination of membership without refund.

8. Photo and Video Release (Optional Section – Check One)

I CONSENT to the use of my image, likeness, voice, and appearance in photographs and videos for marketing, promotional, and advertising purposes.

I DO NOT CONSENT to the use of my image, likeness, voice, and appearance.

9. Governing Law & Venue

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Missouri.

Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction in Missouri.

10. Severability

If any portion of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. Binding Effect

This Agreement is binding upon Participant and their heirs, executors, administrators, assigns, and legal representatives.

ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges that they have read and understood this Agreement in its entirety, understand its legal consequences, and are signing it voluntarily and without coercion.
